Buying property in West Bengal involves four distinct government systems – WBRERA, Banglarbhumi, the Sub-Registrar’s office, and the Block Land Reform office. Each one is separate. Each one has its own process. And a failure at any one of them can derail your purchase or expose you to legal risk.
This guide covers every step, in order.
Step 1: Check WBRERA Registration
Every residential project above 500 sq m built-up area or 8+ units must be registered with WBRERA before a single unit can be advertised or sold.
How to verify:
- Go to rera.wb.gov.in
- Click Registered Projects → Search by project name or builder
- Confirm: Status = Active | Completion date visible | RERA escrow account details available
Non-negotiable rule: No RERA number, no payment. If the builder says “RERA applied” or “RERA exempt” – ask for the exemption order in writing. Most exemption claims are false.
RERA protects you against:
- Possession delays (statutory interest on delay)
- Plan changes without consent (>3% change requires buyer approval)
- Fund diversion (70% of payments must go to RERA escrow, withdrawable only against construction milestones)
For pre-2016 projects still under construction, check HIRA registration at hira.wb.gov.in.
Step 2: Verify Land Title via Banglarbhumi
Before signing any sale agreement, verify the land title at banglarbhumi.gov.in.
What to check:
- RS (Revisional Survey) khatian – owner name, plot number, area
- LR (Land Reforms) khatian – same fields
- RS and LR must match – different owners or plot areas = title dispute
- Land classification – is it residential/homestead, not agricultural-restricted?
- Mutation status – is the current seller’s name reflected in revenue records?
How to check:
- banglarbhumi.gov.in → RS/LR Information
- Select: District → Block → Mouza
- Enter Khatian or Plot (Dag) number
- Download e-Porcha (digitally certified copy) – costs ₹10–₹50, legally valid document

Step 3: Calculate Stamp Duty Before Committing
Stamp duty and registration costs add 6–8% to your purchase price in West Bengal. Calculate this before finalising your budget.
Indicative WB stamp duty rates (verify at wbregistration.gov.in):

Additional 1% surcharge may apply in KMC jurisdiction. Women buyers: check current rebate at wbregistration.gov.in – historically ~2% reduction on stamp duty.
Key rule: Stamp duty is calculated on the higher of declared sale price or government circle rate. If you declare ₹45 lakh but the circle rate values it at ₹50 lakh, duty is on ₹50 lakh.
To pay: Use the e-Stamp system at igrs.wb.gov.in or authorised franking stations.
Step 4: Execute Sale Deed and Register
Documents required:
- Aadhaar + PAN of buyer and seller
- PAN mandatory for transactions above ₹5 lakh
- WBRERA certificate (for new projects)
- Sale deed drafted by a registered property advocate
- Encumbrance Certificate (EC) from wbregistration.gov.in – confirms no existing mortgage or lien
- Property tax clearance (resale properties)
Registration process:
- Execute sale deed on stamped paper (after step 3)
- Present deed at district Sub-Registrar office within 4 months of execution
- Biometric verification of buyer and seller
- Deed registered – you receive a certified copy
Step 5: Apply for Mutation (Daakhil Kharij)
Mutation = updating revenue land records to show you as the new owner. Done at the Block Land Reform (BL) Office.
Important distinction: Registration (Step 4) gives you legal title under the Transfer of Property Act. Mutation updates the government’s revenue record. Both are required.
Apply within 3 months of registration. You’ll need: registered sale deed copy, Aadhaar, and the filled mutation application form. Track status at banglarbhumi.gov.in → Mutation Status.
Complete Pre-Purchase Checklist
- WBRERA registration verified at rera.wb.gov.in (Status: Active)
- RS and LR khatian checked on Banglarbhumi – names and plots match
- e-Porcha downloaded for the specific dag number
- Encumbrance Certificate (EC) obtained – no existing charge
- Circle rate for the area confirmed – stamp duty calculated
- Sale agreement reviewed by a registered property advocate
- RERA escrow account bank name + account number obtained from builder
- Mutation applied within 3 months of registration

Use the formula: Stamp Duty = (Higher of: declared price OR circle rate value) × applicable %
Example: ₹60 lakh flat in KMC area (circle rate value: ₹55 lakh)
- Higher value = ₹60 lakh
- Stamp duty @6% = ₹3,60,000
- Registration @1% = ₹60,000
- KMC surcharge @1% = ₹60,000
- Total additional cost: ₹4,80,000 (8% of ₹60 lakh)
